{"id":116861,"date":"2017-03-29T15:19:02","date_gmt":"2017-03-29T09:49:02","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=116861"},"modified":"2017-03-29T15:19:02","modified_gmt":"2017-03-29T09:49:02","slug":"the-maternity-benefit-amendment-act-2017-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/03\/29\/the-maternity-benefit-amendment-act-2017-notified\/","title":{"rendered":"The Maternity Benefit (Amendment) Act, 2017, notified"},"content":{"rendered":"<p style=\"text-align: justify;\">The following Act of Parliament received the assent of the President on the 27th March, 2017, and is hereby published for general information:\u2014<\/p>\n<p style=\"text-align: justify;\"><strong>The Maternity Benefit (Amendment) Act, 2017 (6 of 2017)<\/strong><\/p>\n<p style=\"text-align: justify;\">An Act further to amend the Maternity Benefit Act, 1961.<\/p>\n<p style=\"text-align: justify;\">BE it enacted by Parliament in the Sixty-eighth Year of the Republic of India as follows:\u2014<\/p>\n<p style=\"text-align: justify;\"><strong>1. Short title and commencement. &#8212;<\/strong>\u00a0(1) This Act may be called the Maternity Benefit (Amendment) Act, 2017.<\/p>\n<p style=\"text-align: justify;\">(2) It shall come into force on such date as the Central Government may, by notification\u00a0in the Official Gazette, appoint :<\/p>\n<p style=\"text-align: justify;\">Provided that different dates may be appointed for different provisions of this Act and\u00a0any reference in any such provision to the commencement of this Act shall be construed as\u00a0a reference to the coming into force of that provision.<\/p>\n<p style=\"text-align: justify;\"><strong>2. Amendment of Section 3.<\/strong> \u2013In the Maternity Benefit Act, 1961 (hereinafter referred to as the principal Act), in Section 3, after clause (b), the following clause shall be inserted, namely:\u2014<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u2018(ba) \u201ccommissioning mother\u201d means a biological mother who uses her egg to\u00a0create an embryo implanted in any other woman;\u2019.<\/p>\n<p style=\"text-align: justify;\"><strong>3.Amendment of Section 5.\u2014<\/strong> In the principal Act, in Section 5,\u2014<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(A) in sub-section (3)\u2014<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(i) for the words \u2018\u2018twelve weeks of which not more than six weeks\u2019\u2019, the words \u2018\u2018twenty-six weeks of which not more than eight weeks\u2019\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(ii) after sub-section (3) and before the first proviso, the following proviso shall be inserted, namely:\u2014<\/p>\n<p style=\"text-align: justify; padding-left: 90px;\">\u2018\u2018Provided that the maximum period entitled to maternity benefit by a woman having two or more than two surviving children shall be twelve weeks of which not more than six weeks shall precede the date of her expected delivery;\u2019\u2019;<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(iii) in the first proviso, for the words \u2018\u2018Provided that\u2019\u2019, the words \u2018\u2018Provided further that\u2019\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(iv) in the second proviso, for the words \u2018\u2018Provided further that\u2019\u2019, the\u00a0words \u2018\u2018Provided also that\u2019\u2019 shall be substituted;<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(B) after sub-section (3), the following sub-sections shall be inserted, namely:\u2014<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">\u2018\u2018(4) A woman who legally adopts a child below the age of three months or a commissioning mother shall be entitled to maternity benefit for a period of twelve weeks from the date the child is handed over to the adopting mother or the commissioning mother, as the case may be.<\/p>\n<p style=\"text-align: justify; padding-left: 60px;\">(5) In case where the nature of work assigned to a woman is of such nature\u00a0that she may work from home, the employer may allow her to do so after availing of the maternity benefit for such period and on such conditions as the employer and the woman may mutually agree.\u2019\u2019.<\/p>\n<p style=\"text-align: justify;\"><strong>4.Insertion of new Section 11A.\u2014<\/strong> In the principal Act, after Section 11, the following section shall be inserted, namely:\u2014<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u2018\u2018<strong>11A.<\/strong> <strong>Cr\u00e9che facility.\u2014<\/strong> (1) Every establishment having fifty or more employees shall have the facility of cr\u00e9che within such distance as may be prescribed, either separately or along with common facilities :<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">Provided that the employer shall allow four visits a day to the creche by the woman, which shall also include the interval for rest allowed to her.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">(2) Every establishment shall intimate in writing and electronically to every woman at the time of her initial appointment regarding every benefit available under the Act.\u2019\u2019.<\/p>\n<p style=\"text-align: right;
