{"id":116411,"date":"2017-03-27T14:05:55","date_gmt":"2017-03-27T08:35:55","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=116411"},"modified":"2017-03-31T13:20:04","modified_gmt":"2017-03-31T07:50:04","slug":"only-50-of-the-casual-workers-service-is-to-be-reckoned-for-calculating-pension-after-obtaining-temporary-status","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/03\/27\/only-50-of-the-casual-workers-service-is-to-be-reckoned-for-calculating-pension-after-obtaining-temporary-status\/","title":{"rendered":"Only 50% of the casual worker\u2019s service is to be reckoned for calculating pension after obtaining temporary status"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: In the case where the respondents who were initially engaged on casual basis and after one or two years were granted the temporary status and thereafter were regularized, had sought for full service benefit for the period during which they were working, having temporary status, the Court held that the\u00a0casual\u00a0worker\u00a0after\u00a0obtaining\u00a0temporary\u00a0status is\u00a0entitled\u00a0to\u00a0reckon\u00a050%\u00a0of\u00a0his\u00a0services\u00a0till\u00a0he\u00a0is regularised \u00a0 on \u00a0 a \u00a0 regular\/temporary \u00a0 post \u00a0 for \u00a0 the purposes\u00a0of\u00a0calculation\u00a0of\u00a0pension. It was further added that the casual worker before obtaining the temporary status is also entitled to reckon 50% of casual service for purpose of pension.<\/p>\n<p style=\"text-align: justify;\">The respondents in the present case were working in the Railways and hence, the Court said that those casual workers who are appointed to any post either substantively or in officiating or in temporary capacity are entitled to reckon the entire period from date of taking charge to such post as per Rule 20 of the Railway Services (Pension) Rules, 1993. The Court held that the Delhi High Court erred in holding that the worker is entitled to reckon 100% of his services for the purpose of calculation of pension and noticed that the perusal of Rules indicate that only half of the period of service of a casual labour after attainment of temporary status on completion of 120 days continuous service if it is followed by absorption in service as a regular Railway employee, counts for pensionary benefits.<\/p>\n<p style=\"text-align: justify;\">The Bench of Dr. A.K. Sikri and Ashok Bhushan, JJ further clarified that it \u00a0 is \u00a0 open \u00a0 to \u00a0 Pension \u00a0 Sanctioning \u00a0 Authority \u00a0 to recommend \u00a0 for \u00a0 relaxation \u00a0 in \u00a0 deserving \u00a0 case \u00a0 to \u00a0 the Railway \u00a0 Board \u00a0 for \u00a0 dispensing \u00a0 with \u00a0 or \u00a0 relaxing requirement \u00a0 of \u00a0 any \u00a0 rule \u00a0 with \u00a0 regard \u00a0 to \u00a0 those \u00a0 casual workers\u00a0who\u00a0have\u00a0been\u00a0subsequently\u00a0absorbed\u00a0against\u00a0the post \u00a0 and \u00a0 do \u00a0 not \u00a0 fulfill \u00a0 the \u00a0 requirement \u00a0 of \u00a0 existing rule \u00a0 for \u00a0 grant \u00a0 of \u00a0 pension, \u00a0 in \u00a0 deserving \u00a0 cases. \u00a0 On \u00a0 a request \u00a0 made in writing, \u00a0 the \u00a0 Pension \u00a0 Sanctioning Authority\u00a0shall\u00a0consider\u00a0as\u00a0to\u00a0whether\u00a0any\u00a0particular case\u00a0deserves\u00a0to\u00a0be\u00a0considered\u00a0for\u00a0recommendation\u00a0for relaxation\u00a0under\u00a0Rule\u00a0107\u00a0of\u00a0\u00a0Rules,\u00a01993.\u00a0[Union of India v.
