{"id":107871,"date":"2017-02-20T15:00:42","date_gmt":"2017-02-20T09:30:42","guid":{"rendered":"http:\/\/www.scconline.com\/blog\/?p=107871"},"modified":"2017-02-20T14:28:15","modified_gmt":"2017-02-20T08:58:15","slug":"transfer-cannot-be-challenged-on-the-grounds-of-personal-inconvenience","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2017\/02\/20\/transfer-cannot-be-challenged-on-the-grounds-of-personal-inconvenience\/","title":{"rendered":"Transfer cannot be challenged on the grounds of personal inconvenience"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Madhya Pradesh High Court:<\/strong> The Single Bench of Sujoy Paul, J. has held that an employee does\u00a0not have any indefeasible right to get transferred at a nearby place, and he cannot challenge a\u00a0transfer order on the mere grounds of personal inconvenience.<\/p>\n<p style=\"text-align: justify;\">In the instant case, the petitioner who was employed at Shahgarh was transferred to Malthon. He\u00a0challenged the transfer order on the ground that he is a heart patient, and his aged mother was\u00a0dependent on him. He also submitted that he could have been transferred to Banda or Sagar, where\u00a0the posts were lying vacant.\u00a0The High Court noted that the respondents had considered that the petitioner was a heart patient\u00a0and he was transferred to a distance of 130 kilometers only. The Court also observed that a transfer\u00a0order can only be interfered with if it runs contrary to any statutory provision (not policy\u00a0guidelines), issued by an incompetent authority, changes the service condition of an employee to\u00a0his detriment or proved to be mala fide. Since, no such ingredient was found in the petition, it was\u00a0accordingly dismissed. [Madan Kumar Athya v.
