While disagreeing with the Single Bench decisions\u00a0in <em>Ashok Kumar Srivastava<\/em> v. <em>State of Uttar Pradesh<\/em>, <a href=\"http:\/\/www.scconline.com\/LoginForNewsLink\/z7Cek7W8\">2012 SCC OnLine All 630 <\/a>and <em>Ved Prakash\u00a0Yadav<\/em> v. <em>State of Uttar Pradesh<\/em>, Criminal Revision No. 3539 of 2015, the Single Bench of Om\u00a0Prakash, J. has referred the matter to a larger bench for an authoritative pronouncement on the\u00a0issue.<\/p>\n<p style=\"text-align: justify;\">In the instant case, the applicant had filed a complaint under Section 138 of the Negotiable\u00a0Instrument Act against the opposite party because two cheques issued by the opposite party were\u00a0dishonoured. The Magistrate after trial acquitted the opposite party. The applicant thereafter filed a\u00a0criminal appeal which was dismissed on the grounds that the appeal against acquittal in a\u00a0complaint case would not be maintainable before the Sessions Judge and the acquittal order can be\u00a0challenged only before the High Court under Section 378(4) CrPC with the leave of the Court.\u00a0The High Court, previously in <em>Ashok Kumar Srivastava<\/em>, and <em>Ved Prakash Yadav<\/em>, had held that the\u00a0appeal against the order of acquittal, by the complainant as well as the victim was maintainable\u00a0before the Sessions Judge under Section 372 CrPC, and they shall not be compelled to seek the\u00a0leave of the High Court.<\/p>\n<p style=\"text-align: justify;\">The Court, in the instant case, opined that the complainant against an order of acquittal can only\u00a0approach the High Court under Section 378(4) CrPC and appeal will not be maintainable before\u00a0the Sessions Judge under Section 372 CrPC. Further, the Court was of the opinion that if victim is\u00a0someone other than the complainant, he may prefer appeal under Section 372 CrPC without leave\u00a0of the Court, but only before the High Court. Expressing its inability to subscribe to the views\u00a0expressed in <em>Ashok Kumar Srivastava<\/em> and <em>Ved Prakash Yadav<\/em>, the Court placed the matter before\u00a0the Chief Justice under the High Court Rules for constituting a larger Bench to resolve the conflict.\u00a0[Anil Kumar Agarwal v.
