On April 06, 2022, the Rajya Sabha passed the Criminal Procedure (Identification) Bill, 2022 and it was passed in the Lok Sabha on April 4, 2022. The Bill seeks to replace the Identification of Prisoners Act, 1920 and authorises the law enforcement agencies to collect, store the physical and biological samples of convicted individuals and other persons for the purposes of identification and investigation in criminal matters.

The Bill expands:

  1. type of data that may be collected;
  2. persons from whom such data may be collected; and
  3. the authority that may authorise such collection.  It also provides for the data to be stored in a central database.
