About the Organisers

 The RMLNLU Society for Excellence in Arbitration Law (SEAL) was established in the year 2015. It is a student-run academic body set up with a view for having insightful discussions on various contemporary developments taking place in the field of Arbitration Law within and outside the country.

About the webinar

The Society for excellence in Arbitration law, RMLNLU is organizing a “Three-part Knowledge Session on Investor-State Arbitration”. The last two parts of the series are to be held on 29th and 30th September, 2020.

Through this series of live sessions, the speaker will aim at explaining, from the utmost basics to the concepts and mechanisms within the Investor-State Dispute Settlement (ISDS) system.

Part-I of the series has covered International Investment Agreements, providing a brief introduction to the treaties and principles of Interpretation and protected investments and investors.

Part-II will cover in detail, Expropriation and its exceptions, including the form of Expropriations and non-precluded measures.

Part-III will deal with standards of treatment such as Most-Favoured Nation, Fair & Equitable Treatment and Full Protection & Security

About the speakers

Ms. Kshama A. Loya: She leads the International Dispute Resolution and Investigation Practice at Nishith Desai and Associates. She specializes in international commercial and investment arbitration, litigation and pre-litigation strategies. She has acted as counsel in various proceedings, including institutional and ad hoc arbitrations, and litigations in Indian courts and tribunals. She has a special focus on advocacy and cross-examination of witnesses. She has advised on disputes and issues arising in a range of industries including Energy, Mining, Infrastructure, Construction, Production, Engineering, Manufacturing, Pharmaceuticals and Life-sciences, Funds, Finances, Consumer Goods, Travel and Transportation, Automotive, Media and Entertainment, Aviation and Advertising.

She holds an LL.M. in International Commercial Laws from King’s College, London, and has studied Negotiation and Dispute Resolution at Harvard Law School, Prior to her LL.M., she worked as a counsel in the Chambers of (then advocate) Justice S.V. Gangapurwala in the High Court of Bombay.

The webinar can be attended by anyone who is interested in the topic. It will be conducted on Webex and log-in details would be provided through email, post-registration.
