Madras High Court: A Division Bench of M. Sathyanarayanan and M. Normal Kumar, JJ., dismissed the present petition as the same involves the issue of reduction of salary of Government Servants as the same comes under the State Government’s ambit.

Public Interest Litigation has been filed wherein it has been submitted that petitioner’s husband is a practicing lawyer belonging to Thiruvannamalai Bar and on account of the COVID-19 lockdown, many Government Servants are not discharging their duties and it would be a colossal waste to pay them the full salary.

Petitioner’s counsel submitted that some fo the States ordered reduction of certain percentage of the salary from the government servants and in view fo the same sought direction to deduct the payment of salary from the government servants.

Court held that the present issue with regard to deduction of salary is a policy decision and the same comes under the State Government’s ambit

Petitioner is neither having a statutory or legal right to compel the State Government to take a decision in this regard.
